強制結婚とは、一方または両方の当事者が同意なく、または意思に反して結婚する結婚である。たとえ両当事者が完全に同意して結婚したとしても、一方または両方が後に意思に反して結婚生活を続けることを強いられた場合、その結婚は強制結婚となる可能性がある。[ 1]
強制結婚は、両当事者が配偶者を見つけて選ぶ際に両親や仲人などの第三者の援助に同意すると考えられる見合い結婚とは異なります。結婚を強制するために用いられる強制には、あからさまな身体的暴力から微妙な心理的圧力まで、一連の強制が用いられることがよくあります。[ 2 ]
強制結婚は国際世論から広く非難されているが、世界中のさまざまな文化圏、特に南アジアとアフリカの一部では、依然として行われている。一部の学者は、「強制結婚」という用語の使用に反対している。なぜなら、この用語は、結婚の合意に基づく正当化の言語(夫/妻など)を、まさにその反対の経験に引き起こすからである。[3]「強制的な夫婦関係」や「夫婦の奴隷制」など、さまざまな代替用語が提案されている。[4] [5]
国連は強制結婚を個人の自由と自律の原則に反する人権侵害の一形態とみなしている。世界人権宣言は、人が配偶者を選び自由に結婚する権利は、その人の生命と尊厳、そして人間としての平等の中心であると述べている。 [6] ローマカトリック教会は強制結婚を婚姻無効の根拠とみなしており、結婚が有効となるためには双方が自由に同意しなければならない。奴隷制度廃止補足条約も、双方が拒否する権利のない結婚を禁止しており[7]、これを防ぐために結婚の最低年齢を定めている。 [8]同様に、国際労働機関は強制結婚を現代の奴隷制度の一形態と認めている。[9]
2009年、シエラレオネ特別法廷(SCSL)の上訴裁判部は、戦争中の「強制結婚」を目的とした女性の拉致・監禁は新たな人道に対する罪であると判断した(AFRCの決定)。[10] [11]チャールズ・テイラー判決において、SCSLの法廷は、「強制結婚」という用語は避けるべきであり、むしろ戦争中の慣行を「夫婦奴隷制」と表現すべきであると判断した(2012年)。[12]
2013年、国連人権理事会は児童婚、早期結婚、強制結婚に反対する初の決議を採択した。この決議は、児童婚、早期結婚、強制結婚を「あらゆる形態の暴力から自由な生活を送ることを妨げ、教育を受ける権利、性や生殖に関する健康を含む最高水準の健康の権利などの人権の享受に悪影響を及ぼす」人権侵害と認め、「2015年以降の開発アジェンダの議論では児童婚、早期結婚、強制結婚の根絶を検討すべきである」とも述べている。[13] [14] [15]この有害な慣習の根絶は、国連の持続可能な開発目標5の目標の1つである。[16]
歴史的背景
18世紀までは、世界中で見合い結婚が非常に一般的でした。 [17]通常、結婚は両親、祖父母、またはその他の親戚によって取り決められました。実際の慣行は文化によって異なりますが、通常は女性の扶養権が父親から花婿に法的に移行します。19世紀と20世紀の女性解放の動きにより、特に財産と経済的地位に関する結婚法が大きく変更されました。20世紀半ばまでには、多くの西側諸国が家族法における配偶者間の法的平等を確立する法律を制定しました。[18] 1975年から1979年にかけて、イタリア、[19] [20] スペイン、[21]オーストリア、[22]西ドイツ、[23] [24]ポルトガルなどの国で家族法の大幅な見直しが行われました。[25] 1978年、欧州評議会は民法における配偶者の平等に関する決議(78)37を可決しました。[26]結婚における完全な男女平等を確立した最後のヨーロッパ諸国には、スイス、[27] [28]ギリシャ、[29]スペイン、[30]オランダ、[31]フランス[32] [33]があり、男性の家族に対する父権は1970年に廃止され、[34]夫が子供の財産を管理する唯一の権限を持つという規定が廃止されたのは1985年の法改正になってからでした。[35]
見合い結婚は強制結婚と同じではない。前者の場合、配偶者は申し込みを拒否できるが、後者の場合、拒否することはできない。しかし、見合い結婚と強制結婚の線引きは、結婚を受け入れ、あらゆる点で両親に従わなければならないという家族や社会からの暗黙の圧力があるため、難しいことが多い。[36] [37]結婚の申し込みを拒否することは、将来の花婿とその家族に対する屈辱と見なされることもあった。
ヨーロッパでは、18世紀後半から19世紀初頭にかけて、ロマン主義の文学的・知的運動が恋愛結婚についての新しく進歩的な考えを提示し、それが社会に受け入れられ始めた。19世紀の結婚習慣はヨーロッパ各地で異なっていたが、一般的には上流階級の間では見合い結婚がより一般的だった。見合い結婚は20世紀初頭以前のロシアでは一般的であり、そのほとんどは同族結婚だった。[38] 児童婚は歴史的に一般的であったが、19世紀と20世紀に疑問視され始めた。児童婚は強制結婚と見なされることが多い。なぜなら、子供(特に幼い子供)は結婚するかどうかについて十分な情報を得た上で選択することができず、家族の影響を受けることが多いからである。[39]
西洋諸国では、過去数十年の間に、結婚の性質、特に夫婦間の生殖の重要性と離婚のしやすさが劇的に変化し、結婚に対する社会的、家族的なプレッシャーが減り、配偶者の選択に関する選択の自由が広がった。[40]
歴史的に、強制結婚は捕虜(奴隷または戦争捕虜)を受け入れ先のコミュニティに溶け込ませ、運命を受け入れるよう要求するためにも使われた。一例として、 1802年から1805年にかけて太平洋岸北西部のヌートカ族に捕らわれて3年間を過ごしたイギリスの鍛冶屋ジョン・R・ジューイットが挙げられる。首長会議は、妻と家族がいれば捕虜と一生一緒にいることに納得できるだろうと考えたため、彼は結婚を命じられた。ジューイットは、自分自身が強制結婚するか、自分と「父」(捕虜仲間)の両方が死刑になるかの選択を迫られた。「一方に死、もう一方に結婚というこの悲しい極限状態に追い込まれた私は、2つの悪のうち、最も軽微と思われるものを選ぶのが適切だと思った」(p154)。[41]
強制結婚は、人口目標を達成する手段として権威主義的な政府によっても行われていた。カンボジアのクメール・ルージュ政権は、人口を増やし革命を継続するために、組織的に人々に結婚を強制した。[42]
これらの結婚式には少なくとも 3 組のカップルが参加し、最大で 160 組のカップルが参加することもあった。一般的には、村長またはコミュニティの上級リーダーが両当事者に近づき、結婚すること、および結婚式の日時と場所を告げる。結婚式は、将来の配偶者が初めて会う機会となることが多かった。両親やその他の家族は、配偶者の選択に参加したり、結婚式に出席したりすることは許されなかった。クメール ルージュは、親権は「すべての人の『母と父』であるべき」であるため不要であると主張した。[42]
ラプティオとは、結婚や奴隷化(特に性的奴隷)を目的とした大規模な女性の誘拐(拉致)を指すラテン語である。この慣習は人類学的には古代から一般的であったと推測される。[43]
21世紀に入り、強制結婚は、それが一般的である文化からの移民という文脈の中で、ヨーロッパ諸国で注目されるようになった。イスタンブール条約は強制結婚を禁止している(第37条参照)。[44]
強制結婚を禁止する法律のタイムライン

- 1889年:日本の新しい法律では結婚に夫婦双方の同意が必要とされたが、女性が徐々に教育を受け経済的に自立するようになった20世紀初頭までは、女性の同意は依然として強制される傾向にあった。[50]
- 1901年:ジンバブエは強制結婚を禁止したが、密かに慣習が続いた。[51]
- 1917年:オスマン帝国の家族法は強制結婚を禁止した。[49]
- 1926年:ウズベキスタンの刑法で強制結婚が犯罪と定められた。[52]
- 1928年:アルバニア:1928年の民法は強制結婚を禁止し、既婚女性に離婚と平等相続の権利を与えた。[53]
- 1928年:カザフスタンの刑法で強制結婚が犯罪と定められた。[52]
- 1946年:北朝鮮は強制結婚と女性の売買を禁止した。[54]
- 1950年:中国は新婚法によって強制結婚を禁止した[55]

- ジョージア州では強制結婚は犯罪とされ、最大400時間の公共労働または最大2年の懲役刑が科せられる。[70]

- ガンビアは強制結婚を禁止した。[86]
- カメルーンは強制結婚を犯罪とした。[87]
- ニュージーランドは強制結婚を犯罪とみなした。[88]
- 2018年:モロッコは強制結婚を犯罪とした。[89]
- 2022年:インドネシアは最高9年の懲役刑を伴う強制結婚を禁止した。[90]
コンベンション
奴隷制度廃止に関する補足条約
1956年の奴隷制度、奴隷貿易、奴隷制度に類似する制度や慣行の廃止に関する補足条約では、「奴隷制度に類似する制度や慣行」を次のように定義しています。[91]
c) 以下の行為を行う機関または慣行:
- (i)女性が、拒否権を持たずに、両親、保護者、家族、その他の個人またはグループに金銭または現物による対価を支払って結婚を約束されたり、結婚させられたりすること。
- (ii)女性の夫、その家族、またはその一族は、受け取った対価またはその他の対価と引き換えに彼女を他の人に譲渡する権利を有する。
- (iii)女性は、夫が死亡した場合、他の人に相続される可能性がある。
イスタンブール条約
欧州評議会の女性に対する暴力と家庭内暴力の防止と撲滅に関する条約(イスタンブール条約とも呼ばれる)では次のように規定されている。[44]
第32条– 強制結婚の民事上の結果
締約国は、強制によって締結された婚姻が被害者に過度の財政的または行政的な負担をかけることなく、無効にされ、破棄され、または解消されることを確保するために必要な立法措置またはその他の措置を講じなければならない。
第37条– 強制結婚
- 締約国は、成人または児童に結婚を強制する意図的な行為が犯罪とされることを確保するために必要な立法措置またはその他の措置を講じなければならない。
- 締約国は、成人または児童をその者が居住する国または国以外の締約国または国の領域に誘い込み、当該成人または児童に結婚を強制する意図的な行為が犯罪とされることを確保するために必要な立法措置またはその他の措置を講じなければならない。
種類
強制結婚を容認し奨励する文化につながる要因は数多くある。強制結婚を行う理由としては、親族の絆を強める、望ましくない行動や性欲を抑制する、不適切な関係を防ぐ、文化的価値観を守り遵守する、富を親族内に留める、婚外妊娠の結果に対処する、結婚を親の義務とみなす、貧困に対する保証を得る、移民を支援する、などが挙げられる。[92] [93]
持参金と花嫁価格との関係
持参金と花嫁価格の伝統的な慣習は、強制結婚の慣行に寄与している。[94] [95] [96]持参金とは、結婚時に妻(または妻の家族)が夫に持参する財産または金銭である。[97]花嫁価格とは、結婚時に花婿(またはその家族)が花嫁の両親に支払う金額、財産または富である。
誘拐による結婚
誘拐結婚は花嫁誘拐としても知られ、男性が結婚したい女性を誘拐する慣習である。誘拐結婚は世界中で歴史を通じて行われており、今日でも一部の国、特に中央アジア、コーカサス、アフリカの一部で発生し続けている。少女または女性が花婿に誘拐され、花婿は友人に助けられることが多い。被害者は花婿に強姦されることが多く、処女を奪われる。そうすることで、男性は村の長老と花嫁価格を交渉し、結婚を合法化することができる。[98] [99] [100]ほとんどの場合、将来の花嫁には選択の余地がなく、受け入れるしかない。花嫁が家族の元に戻ると、彼女(と家族)はコミュニティから追放されることが多い。コミュニティは彼女が処女を失い、今や彼女は「不浄」であると考えるからである。[101]結婚誘拐の別の形態である花婿誘拐は、持参金の支払いが一般的に期待されている一部の地域で発生します。
債務交渉として
金銭結婚とは、通常、少女が親の借金を返済するために男性と結婚させられる結婚を指す。[102]
紛争解決として
強制結婚は家族間の争いの結果であることが多く、その争いは一方の家族からもう一方の家族に女性を与えることで「解決」されます。ヴァニはパキスタンの一部に見られる文化的慣習で、若い女の子が男性の親族が犯した罪に対する罰の一環として強制的に結婚させられます。[103]ヴァニは強制児童結婚の一種であり、[104]ジルガと呼ばれる部族の長老会議によって決定された罰の結果です。[105] [106]
未亡人の相続
未亡人相続は花嫁相続としても知られ、未亡人が亡くなった夫の親族、多くの場合は夫の兄弟と結婚することを義務付ける文化的、社会的慣習である。これはアフリカの特定の地域で広く行われている。妻の相続の慣習はHIV/AIDSの蔓延の原因とも言われている。[107]
戦争で略奪される
「紛争地域では、女性や少女が紛争当事者の男性と結婚させられることがある。この習慣は最近、シリア、シエラレオネ、ウガンダ、コンゴ民主共和国などの国で行われている。歴史的に、これは世界中で一般的であり、戦争の敵国のコミュニティの女性は「戦利品」と見なされ、誘拐され、強姦され、結婚や性的奴隷に強制される可能性がありました。」[108]女性は財産と見なされていたため、女性を戦争の敵国の動産と見なすのは合理的であり、勝者がそれを占有して使用できるように思われた。[109]
強制結婚
強制結婚とは、計画外の妊娠によって引き起こされる強制結婚の一種である。一部の宗教や文化では、婚前交渉や婚外出産は罪深く、法律で認められておらず、烙印を押されているという理由から、そのような状況で結婚することは道徳的義務であると考えている。 [110]婚外出産は、一部の文化では、家族やコミュニティから名誉殺人を含む極端な反応を引き起こす可能性がある。[111] [112] [113]
「できちゃった結婚」という用語はアメリカの口語だが、世界の他の地域でも使われている。[説明が必要]これは、妊娠した(または単に「処女を奪った」だけの)女性の父親が、妊娠をさせた男性パートナーが結婚を続行するように強制(ショットガンで脅すなど)に訴え、時には逃げられないように祭壇まで男性を追いかけるという誇張されたシナリオに基づいている。結婚を強制するために暴力を使用することは、米国では合法ではなかったが、 18世紀と19世紀には多くの逸話や民謡にそのような脅迫の例が記録されている。結婚の目的には、妊娠行為に対する男性の訴えを取り下げること、子供が両親によって育てられるようにすること、女性が物質的な支援手段を持つようにすることなどがある。場合によっては、母親の 社会的名誉を回復することが主な目的であった。
婚外出産に伴う汚名が徐々に薄れ、そのような出産の件数が増加したため、強制結婚は一般的ではなくなってきている。また、避妊、性教育、中絶の利用可能性が高まり、また、医療補助金、児童手当、育児休暇、幼稚園の無償化など、未婚の母親への物質的支援も増加したため、そのような対策の必要性は認識されなくなっている。
結果
被害者と社会のために
早すぎる結婚や強制結婚は、少女たちが貧困と無力の悪循環に陥る一因となる可能性がある。少女たちの多くは、暴力、虐待、強制的な性交などの虐待を受ける可能性が高い。つまり、若くして結婚した女性は夫に支配される可能性が高くなる。また、性的・生殖的健康も悪くなる。若くして結婚した少女たちはHIVに感染する可能性が高く、健康が危険にさらされる可能性がある。強制結婚させられた人々の多くは教育を受けておらず、多くの場合、読み書きができない。若者は結婚する直前に学校を中退する傾向がある。[114]
強制結婚は、生涯にわたる強姦、虐待、家庭内奴隷状態、生殖権、経済的権利、基本的人権の喪失を意味することが多い。女性や少女にとって、強制結婚は強制的に母になることを意味することが多い。[1]
強制結婚からの逃避
強制結婚を終わらせることは、世界の多くの地域では非常に難しいかもしれない。例えば、アフリカの一部では、結婚を解消するための主な障害の1つは花嫁代金である。花嫁代金が支払われると、女性は夫とその家族の所有物とみなされる。女性が離婚を望む場合、夫は女性の家族に支払った花嫁代金の返還を要求することができる。女性の家族は、返済できないか、返済したくないことが多い。一部の国では、男性が後見人となることを義務付け、女性が自分で支払うことを禁止しているが、他の国では何度もそのような事例が発生している。[115] [116] [117]
強制結婚から逃れようとする英国国民は、送還費用を支払うか借金をするかを迫られる。このため、強制結婚から逃れることはより困難になる。[118]
アメリカでは、アンチェインド・アット・ラストが、強制結婚や見合い結婚から逃れようとする米国民に無料の法的・社会的サービスを提供する唯一の非営利団体である。[119]
名誉殺人
強制結婚は、結婚生活の中で行われる暴力(家庭内暴力)と、結婚を望まない相手に結婚を強制するため、または結婚を拒否した相手を罰するために行われる暴力(極端なケースでは、結婚を受け入れない女性や少女が名誉殺人の対象となる)の両方において、暴力と関係していることが多い。[120] [121] [122]
立法上の結果

管轄区域によって、強制結婚は無効または無効にできる場合とできない場合があります。被害者は婚姻無効または離婚を通じて救済を求めることができます。イングランドとウェールズでは、1973年の婚姻原因法で強制結婚は無効にできると規定されています。 [123]一部の管轄区域では、被害者を結婚に強制した人が刑事告訴される可能性があります。[124] [125] [126]
シャリーア法
イスラム法では、有効な結婚には同意が必要である。[127]イスラムの結婚は、新郎と新婦の間ではなく、新婦の後見人(ワリー)と新郎の間で締結される(ただし、新婦は除く)。ただし、彼女の許可は必要である。新婦の後見人(ワリー)は、自由なイスラム教徒でなければならない。[128]ワリーは、思春期前の子供に代わって結婚契約を開始する権限を有するが、子供が思春期に達すると、子供は結婚を受け入れるか拒否するかを選択できる。結婚契約は、強制を理由に無効にすることができる。[127]
しかし、ハナフィー学派の法学では、結婚を有効にするために保護者は必要ない。[129]
国別
アフリカ
マダガスカル
マダガスカルでは強制結婚が蔓延している。少女たちは家族によって結婚させられ、結婚を拒否すると「呪われる」と信じ込まされることが多い。[130] [131]場合によっては、夫が花嫁よりずっと年上で、彼女が未亡人になると、社会から差別され排除されることもある。[132]
マラウイ
ヒューマン・ライツ・ウォッチによると、マラウイでは「児童婚と強制結婚が広く行われ」、少女の半数が18歳未満で結婚している。[133]マラウイではロボロとしても知られる花嫁価格の慣習が一般的で、強制結婚に大きな役割を果たしている。マラウイでは妻の相続も行われている。結婚後、妻の権利と自由は非常に制限されており、若い女性の結婚準備は一般的に、夫に従属する役割を担うことで構成されている。[134]
モーリタニア
モーリタニアにおける強制結婚には、従兄弟との強制結婚(マスラハと呼ばれる)、金銭目的の裕福な男性との強制結婚、そして影響力のある男性との強制的な一夫多妻結婚という3つの主要な形態がある。[135]
モロッコ
2018年、バシマ・ハッカウイが起草したためハッカウイ法として知られる法律が施行された。この法律には、強制結婚の禁止などが含まれている。
ニジェール
ニジェールでは強制結婚が一般的である。ニジェールは児童婚の蔓延率が世界で最も高い国である。[136] [137]また、合計特殊出生率も最も高い。[138]強制結婚から逃れようとする少女たちは、ほとんどの場合、家族から拒絶され、生きるために売春を強いられることが多い。[139]食糧危機のため、少女たちは結婚のために売られている。[140]
バルキッサ・チャイブーは、ニジェールにおける強制結婚に反対する最も有名な活動家の一人として知られている。チャイブーは12歳のとき、母親から従妹と結婚すると告げられ、16歳のとき法廷に立った。ほとんど成果は得られず、チャイブーは女性シェルターに強制収容された後、ようやく家に帰ることができた。そこで彼女は、両親が強制結婚に対する考え方を変え、今は反対していることを知った。[141]
ソマリア
2020年8月にソマリアで提案された「性交関連犯罪法案」は、児童婚と強制結婚の両方を認めるものである。国連人権高等弁務官のミシェル・バチェレ氏は、この新法案は「児童婚などの憂慮すべき慣行を合法化するリスクがある」と述べた。ソマリアでは、モガディシュに拠点を置くエルマン平和人権センターの代表者を含む数千人がこの法案に反対する請願書を配布した。ソマリアの若い女性の45%以上が18歳未満で結婚または「結婚」している。[142]
南アフリカ
南アフリカでは、ウクトワラとは少女を誘拐し、両親の同意を得た上で結婚を強制する慣習である。[143]この慣習は主に南アフリカの農村部、特に東ケープ州とクワズール・ナタール州で行われている。[144]この慣習に関わっている少女は未成年であることが多く、中には8歳の少女もいる。[145]この慣習は悪評を浴び、2009年には東ケープ州の少女20人以上がウクトワラのために毎月学校を退学させられているとメディアが報じた。[146]
タンザニア

アジア
代償結婚
代償結婚は、ヴァニ、スワラ、サンチャッティなどとも呼ばれ、パキスタンとアフガニスタンの一部で部族間の争いを解決するために女性や少女を強制的に結婚させる伝統的な慣習である。この慣習はパキスタンでは違法であるが、パキスタンのハイバル・パフトゥンクワ州では今でも広く行われている。アフガニスタンでは、この慣習はバードとして知られている。
アフガニスタン
アフガニスタンでは強制結婚が非常に一般的で、女性たちはこうした結婚から逃れるために自殺に訴えることもある。[152]ヒューマン・ライツ・ウォッチの報告書によると、アフガニスタンで投獄された少女の約95%と成人女性の50%は、家出やジナという「道徳的犯罪」の罪で投獄されていた。夫の同意なしに離婚することはアフガニスタンではほぼ不可能であり、事実上の別居を試みる女性は「家出」で投獄される危険がある。女性や少女が許可なく家を出ることは社会的に受け入れられないが、「家出」はアフガニスタン刑法では刑事犯罪として定義されていない。しかし、2010年と2011年にアフガニスタン最高裁判所は裁判所に対し、女性を「家出」で犯罪として起訴するよう指示した。これにより、女性が強制結婚から逃れることはほぼ不可能になっている。ヒューマン・ライツ・ウォッチの報告書は次のように述べている。

中国
近隣諸国の中国人男性と女性の間で強制結婚が行われた事例が記録されている。これらの女性は通常、偽りの仕事の約束によって中国に誘い出され、結婚を強制される。[157] [158]
インドネシア
インドネシアの部族の中には、強制結婚とみなされる伝統や慣習を持つ者もいる。例えば、古い慣習を今も守るササク族は、娘が夜遅くまで男性と出かけた場合、すぐに結婚しなければならないと信じている。スンバ島の人々も花嫁誘拐を実践している。[159]
しかし、2022年4月、インドネシア議会は性暴力犯罪に関する2022年法律第12号を可決した。この法律は強制結婚を性的暴力の一形態とみなして違法とし、違反者は最長9年の懲役および/または2億ルピアの罰金を科せられる可能性がある。強制結婚の形態には、児童婚、強姦被害者を強姦犯と結婚させること、地元の慣習の名の下に結婚を強制することなどが含まれる。[160] [161]
イラン
イランでは少女の強制結婚が依然として一般的であり、イランでの焼身自殺の主な原因の一つでもある。 [162] 2021年にユニセフは、イランのクルディスタンにおける強制結婚の割合が高く、幼い年齢での結婚も含まれるが、その慣行は減少していると報告した。 [ 162 ]児童強制結婚の慣行を促進するクルド人の文化的規範は、イランのクルド人少女の間で暴力への恐怖を永続させている。[162]
ネパール

強制結婚は、家族の誇り、両親の希望、社会的義務などから行われることがある。例えば、ルカイヤ・ワリス・マクソードによれば、英国におけるパキスタン人コミュニティ内での多くの強制結婚は、強制結婚の扇動者が義務感を感じている、現在パキスタンにいる家族の一員に英国市民権を与えることを目的としているという。 [170]英国における移民の強制結婚の問題を受けて、2007年に強制結婚(市民保護)法(イングランド、ウェールズ、北アイルランドに適用)が可決され、強制結婚の被害者は裁判所の保護命令を申請できるようになった。スコットランドでも同様の法律が可決され、2011年に強制結婚等(保護および管轄権)(スコットランド)法[124]が裁判所に保護命令を発行する権限を与えている。
2008年には、毎年約3,000件の強制結婚が行われているものと推定された。[171]
2012年6月、デービッド・キャメロン首相率いる英国政府は、強制結婚は英国で刑事犯罪となると宣言した。[172] 2013年11月、当時14歳だった少女がパキスタンに連れて行かれ、10歳年上の男性と結婚させられ、2週間後に脅迫されて結婚を強要され、妊娠した事件がバーミンガムの高等裁判所に地方自治体職員によって提起されたと報じられた。裁判は、ホルマン判事が、彼女の結婚が「最初から無効」であるという宣言を与えることが法律で禁じられているため、強制結婚の「不承認宣言」を行う権限がないと述べて終了した。ホルマン判事は、現在17歳の少女は、結婚を無効にするために自分で手続きを開始しなければならないと述べた。[173] [174]英国の裁判所は強制結婚を防止するための民事命令を発行することもでき、2014年以降、そのような命令に従わない場合は最長5年の懲役刑の根拠となっている。[175]

2014年7月、英国は初の世界ガールサミットを主催した。サミットの目標は、児童婚、早期結婚、強制結婚、女性器切除を1世代以内に終わらせるための取り組みを強化することだった。[180]
英国で強制結婚の有罪判決が下されたのは2015年6月で、有罪判決を受けたのはカーディフ出身の男性で、その後懲役16年の判決を受けた。[181]
外務省と内務省が共同で運営する政府の強制結婚ユニットが記録した事件のうち、[ 182]大半は南アジアのコミュニティに関係しており、37%がパキスタン、11%がバングラデシュ、7%がインドに関連している。約30%は18歳未満の被害者である。[183]
スウェーデン
2014年7月、意に反して結婚を強いられた個人を保護するため、強制結婚が犯罪とされた(スウェーデン語:äktenskapstvång)。最高刑は懲役4年である。[184] 2019年1月現在、最高刑を言い渡した裁判所はない[update]。[要出典]
スウェーデン南部のスコーネ地方の学校では、恥ずべき社会の一員であるという理由で毎年約25人の若者が結婚を強いられていることがわかったと報告している。政府機関であるUngdomsstyrelsenによる調査では、7万人の若者が配偶者の選択において自由がないと感じていると報告されている。[185]
2016年7月、スウェーデンのアフガニスタン人男性が、娘をアフガニスタン人と結婚させた罪で懲役4年の判決を受けたが、これはスウェーデンで初めての有罪判決であった。彼はまた、娘のスウェーデン人ボーイフレンドへの性的虐待、暴行、脅迫、強盗、恐喝、不法監禁の罪でも有罪判決を受けた。[186]
2019年1月、イラク人家族の16歳の少女の母方の叔父と叔母が、強制結婚の罪で懲役21ヶ月と損害賠償1万2500ユーロの判決を受けた。2016年12月、少女が男性と交際していることが家族に発覚し、家族は少女に内緒で従兄弟と結婚させることにした。祖母が重病だという偽りの口実で、少女、母親、叔父、叔母は、少女以外の全員が帰りの航空券を持っていたイラクに渡った。イラクで祖母の健康状態が良好であることが判明し、少女はいとこと結婚することとなった。イラクに連絡先はなく、携帯電話も取り上げられていたにもかかわらず、少女は8ヶ月後にスウェーデンに帰国することができた。[187]
他の
ヨーロッパにおける強制結婚は主に移民集団の中で見られるが、東ヨーロッパのロマ人コミュニティを中心に、一部の地元住民の間でも見られる。[188]
2011年に発表された英国の強制結婚に関する調査では、オーストリア、ベルギー、トルコ、デンマーク、ノルウェー、ドイツでは強制結婚は明確な犯罪行為であると判明した。[189] 2014年にはイングランドとウェールズでも明確な犯罪行為となった。[175]
欧州評議会の女性に対する暴力および家庭内暴力の防止と撲滅に関する条約は、強制結婚および女性に対するその他の形態の暴力を定義し、犯罪としている。[190]この条約は2014年8月1日に発効した。[191]

アメリカ大陸
カナダ

ニュージーランド
強制離婚
国際的に報道され批判された強制離婚の事例が、2005年7月にサウジアラビアで発生した。[ 213]アル・ジュフ州第一審裁判所のイブラヒム・アル・ファラジ判事は、マンスール・アル・ティマニとファティマ・アッザズのほぼ3年間続いた結婚を、夫の部族の社会的地位は彼女の部族に比べて不十分であるというアッザズの異母兄弟からの苦情に応じて、欠席裁判で無効とした。兄弟たちはまた、アル・ティマニが自分の背景を偽って伝えたと述べた。[ 215 ] [216] [213]異母兄弟は、ファティマが未婚の間男性の法的保護者であった(そして後に亡くなった)ファティマの父親から得た委任状で訴訟を起こした。アル・ティマニは9ヵ月後の2006年2月まで離婚届を受け取らなかった。[217]
