南軍とアメリカ合衆国における将官の任命、指名、承認の手続きは基本的に同じであった。アメリカ合衆国の軍法では、将官に指名される人物は大統領によって指名され、上院によって承認され、その任命書には大統領が署名し、封印することが義務付けられていた。
死後の任命確認や委任状の交付は認められないという法解釈にもかかわらず、米国上院と南部連合上院は、死亡が確認されている士官の任命をいくつか確認し、最近死亡した、または委任状を受け取る前に死亡した士官のその他の確認済みの任命をいくつか取り消したり、取り消したりしなかった。南部連合軍では名誉任命は行われなかったが、20名の代理または臨時の将校が南部連合法によって認可され、任命された。少なくとも1つの州民兵（バージニア州）には、少なくとも1人の名誉将軍（フランシス・ヘニー・スミス）がいた。
